Straight answers
No. Roughly two out of three initial applications are denied nationally, and a large share of claims are approved later in the process — at reconsideration or at a hearing before an administrative law judge. A denial usually means the file needs more or better evidence, not that you don’t qualify.
You generally have 60 days from the date on your denial letter. Miss that window and you may have to start the whole claim over, which can cost you months and affect your back pay. If your letter is dated recently, this is the thing to act on first.
Nothing up front, and nothing at all unless you win benefits. Social Security sets attorney fees by law — the fee is capped at 25% of your past‑due benefits or a statutory maximum, whichever is lower, and it must be approved by Social Security. In 2026 that statutory maximum is $9,200.
You are not required to have one. But the appeals process is evidence‑driven and deadline‑driven, and most denials come down to gaps a representative is trained to spot — missing records, an incomplete work history, a form filled in the way that hurts you. Having someone handle the SSA correspondence and speak for you at the hearing is where most of the value sits.
No. Our office is in Evansville, but we represent claimants in all fifty states, and much of the process is handled by phone, mail and video hearing. We regularly work with clients across Atlanta, Chicagoland, Greater Cincinnati, Indianapolis, Kansas City, Lexington, Southern Illinois and St. Louis.
It depends on your state and the stage you’re at. An initial decision often takes several months; a hearing can take considerably longer. We can give you a realistic range for your area on the consultation call rather than a number that sounds good on a website.
For your future
Free consultation, no obligation, and no fee unless you win. If you were recently denied, the 60‑day clock is already running.
